Federal Court Mandates Release of Abrego Garcia from ICE Detention

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without legal authority.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.

The situation stems from a mistaken deportation to El Salvador in March, which US authorities later admitted was an mistake. Following his repatriation to the United States to answer human smuggling charges, he was held in immigration detention.

In her order, the judge pointed out that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The legal challenge center on disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in Tennessee.

The court, who was overseeing his petition to deportation in a federal court, determined that he must now adhere to the terms of his release from jail in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.
